Eminent Domain
I serve as one of the preferred mediators in the 5th and 2nd Districts of the FDOT and mediated for multiple condemning authorities, including, but not limited to: the Florida Expressway Authority, Duke Energy, Peoples Gas, Orange, Osceola, Citrus, Marion and Brevard Counties, the cities of Palm Beach, Panama City Beach, Jacksonville, Orlando, Inverness, Ocala, DeLand, Daytona Beach, Sanford, and Viera. I have conducted several hundred condemnation mediation cases through 2024.
Securities
During all phases of securities litigation, including Financial Industry National Regulatory Association binding arbitration cases, State cases under the Florida Securities and Investor Protection Act, and Federal cases under all Federal regulatory acts.
Class Action
Services provided at both pre-certification and post-certification stages in actions in either State or Federal court involving certification issues or claims settlement processes and procedures. Also serve as a Special Master supervising claims made settlement programs or disputes regarding the application or interpretation of settlement terms and procedures.
Arbitration
I serve as one of the designated arbitrators in the 5th judicial Circuit and have conducted dozens of binding and non-binding arbitration through 2024.
Standard Rates
Mr. Spivey’s rates vary for different case types and are usually set by agreement prior to engagement on a case by case basis. Standard Rates – $350 per hour; $700 minimum; $175 per hour for travel and pre-mediation preparation.
